AUHSD-AEA 2008-2009 Negotiations Tentative Agreement

AEA Sunshined the following Automatic Re-openers.
Article 3: Salaries/salary schedule and Stipends (Schedule B) and
Article 12: Employee Benefits

Background information:
        The State is in a financial crisis and only a 0.68 COLA was passed on to schools. A Deficit Factor of 4.71% was established
for future years.
        Step and Column costs were about $400,000 this year.
        Health Benefits increased to the 2009 Kaiser family rate for Active employees and to the 2009 Kaiser single party and
2009 Kaiser double party for Retirees at a cost of $217,000.
        The cost of a 1% raise on the salary schedule is $256,011.
        Step and Column and increased Benefits were an additional cost to the District of $617,000. This is equivalent to a 2.4%
increase on the Salary Schedule.

AEA also opened 3 additional Contract articles.

New Article: Association/Member Rights

The MOU for Master Scheduling was also an automatic re-opener this year.


The Tentative Agreement Includes:

Employee Benefits
•        The current level of Benefits will increase to the new 2009 Kaiser rate. There is an MOU to start a Benefit Committee
with SEIU, the District and a confidential employee (they have no union).
•        There is a slight improvement on the Master and PhD stipends to $1100 and $1600 per year.
•        A new position of Lead Counselor was created for schools that no longer have an administrative position of Head Counselor
and will be placed on Schedule B at the Department Chair – Tier 3 Base Stipend rate.
•        The Special Ed Department Chair was moved from the Tier 2 Base Stipend rate to the Tier 3 Base Stipend rate.
•        There will not be an increase on the Salary Schedule this year.

Memorandum of Understanding: Development of the 2007-2008 Master Schedule
•        The timelines and language of this Tentative Agreement from last year were refined and placed in Article 8. It insures
teacher input into the scheduling process. Unit members will know their teaching assignment including course and prep periods for
the following year by the last teacher workday in June and be informed of any necessary changes that may occur over the summer.

Article 5: Teaching Hours
•        The Extra Duty Committee at each site will attempt to reduce the number of extra duties. The District Office will
monitor what is being required to help insure equity among the sites.
•        The following was inserted in the contract, “The ending time for both Open House and Back to School Night will be no later
than 8:30 pm. Unit members will be required to report no earlier than 6:00 pm for a maximum of two hours of assigned duty.” In
addition we will work through the Calendar Committee to schedule them on a Tuesday so we have a late start Wednesday morning
without meetings.
•        The Negotiators will continue to discuss Prep Period subbing as part of this negotiation cycle. There are several ideas being
discussed, but we could not come to a resolution as of Wednesday December 3. To insure unit members who have a health plan
that costs more than the Kaiser Family plan will not have the additional cost taken from their checks in January, both sides
agreed to come back to this one issue only.

Article 15: Working Conditions
•        The District has produced the
AUHSD Advisement Regarding Staff Communication Practices.  Among other points, it
states “While timeliness may vary by the urgency to resolve an issue, generally a forty-eight hour response to an inquiry is a
reasonable professional practice.”

New Article: Association/Member Rights
It was decided not to make a new Article but to add language to
Article 4 – Organizational Security.
•        “As a basic operating principle, the District and the Association believe that a collaborative approach to settling issues is
preferable to both parties seeking legal remedies for routine situation. Unit Members and Association representatives are
encouraged to consult with site and District administration regarding any issue impacting his/her conditions of employment.”
•        AEA will get information from the District in a timely manner.
•        AEA will be allowed to place membership forms in the District’s new teacher information packet.
•        Unit members may use of District email, bulletin boards and school mailboxes for Association business.
•        AEA Representatives have access to campuses other than the one they work at and may hold meetings utilizing available
district facilities.

In addition, the following language was inserted into
Article 6 – School Year Calendar.
•        “Teacher work days are primarily for the purpose for completing grading and other end-of-semester activities such as
checking out. Baring emergencies, no required meetings shall be scheduled on these days.” This is to ensure these days are spent
doing what we feel we need to do without oversight from the administration.
